Terms of Service

Effective date: October 6, 2026

These Terms govern use of PracticeCal, provided by HM Behavioral Health, LLC, doing business as PracticeCal (“PracticeCal,” “we,” “us”). By registering a practice or signing in, you agree to these Terms on behalf of yourself and, for practice administrators, the practice you register (“Practice”).

1. The service

PracticeCal copies appointments from a Practice’s Tebra account to its providers’ Google Calendars. If a provider chooses, it also places “Unavailable” holds in Tebra for times the provider is busy on Google Calendar. Features may change over time.

3. Patient information and HIPAA

Patient information is handled under a Business Associate Agreement between PracticeCal and the Practice, which controls if it conflicts with these Terms. The Practice is responsible for having a lawful basis to send its schedule information to providers’ Google Calendars, and for ensuring providers’ Google accounts are appropriate for that information (for example, Google Workspace accounts covered by the Practice’s own agreement with Google).

4. Tebra remains the system of record

PracticeCal is a convenience tool. Tebra is the authoritative schedule. Synced events can be delayed, incomplete or briefly out of date, for example when Tebra or Google is unavailable. Do not rely on PracticeCal alone for clinical, scheduling or emergency decisions. “Unavailable” holds are visual cues and do not prevent bookings in Tebra.

5. Acceptable use

Don’t misuse PracticeCal. That includes accessing accounts or data you aren’t authorized to access, interfering with the service, reverse engineering it except as allowed by law, or using it in violation of law or of Tebra’s or Google’s terms.

6. Third-party services

PracticeCal works with Tebra and Google, which are separate services under their own terms. We aren’t responsible for their availability or changes they make that affect the sync.

7. Pilot pricing

PracticeCal is free during the pilot. We will give at least 30 days’ notice by email before any fees apply. You can stop using PracticeCal at any time.

8. Ending use

Providers can pause or disconnect at any time, and a Practice can stop using PracticeCal at any time. We may suspend or end access for violations of these Terms or to protect the service or others. When use ends, data is handled as described in our Privacy Policy and the BAA.

9. Disclaimers

PRACTICECAL IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY OR ERROR-FREE.

10. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, PRACTICECAL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO PRACTICECAL WILL NOT EXCEED THE GREATER OF THE AMOUNTS PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.

11. Indemnity

The Practice will defend and indemnify PracticeCal against third-party claims arising from the Practice’s or its users’ violation of these Terms or of law.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Barnstable County, Massachusetts.

13. Changes

We may update these Terms. For material changes, we will notify practice administrators and providers by email at least 30 days before they take effect. Continuing to use PracticeCal after that means you accept the updated Terms.
